Introduction

Purpose
The purpose of this module is to:

  • Describe the evidentiary issues that commonly arise in domestic violence cases;
  • Explain the standards for determining admission of hearsay evidence and expert testimony.

Learning Objectives
After viewing this module, you will:

  • Be familiar with common evidentiary issues that arise in domestic violence cases;
  • Know how to determine the admissibility of out-of-court statements in light of the availability of the witness and the intended purpose of the evidence;
  • Understand the considerations for admission of expert testimony.

What You Can Expect in This Module
In this module, you will:

  1. Watch videotapes of a law professor and attorneys examining the rules governing the admission of hearsay evidence and expert witness testimony;
  2. See brief videotaped scenarios of evidence issues that arise in the courtroom, with analysis and commentary by experienced attorneys;
  3. Have access to a hearsay evidence chart and a chart on admitting expert witness testimony;
  4. Participate in an online discussion about the module;
  5. Be able to link to related resources;
  6. Work through an exercise on expert witness testimony.
